Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you", or "your") and Pettersen Advisory, org. nr. 937 278 837, a company registered in Norway, operating under the trade name Agent Fuel ("we", "us", or "our"), governing your access to and use of the Agent Fuel platform, services, and intelligence files delivered through agentfuel.com (collectively, the "Service"). By purchasing, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms. If you do not agree to these Terms, you may not access or use the Service.

Agent Fuel provides structured competitive intelligence files designed for use with AI agents and large language models. The Service includes: a) Starter Package: A one-time delivery of a structured intelligence file (JSON format) containing competitor analysis, market benchmarks, industry context, and positioning data customized for your company. b) Pro Package: The Starter intelligence file plus bi-weekly refresh files containing updated competitor data, market shifts, and new benchmarks, delivered automatically for the duration of your subscription. c) Team Package: Multiple intelligence files tailored to different roles within your organisation (e.g., sales, product, strategy), with bi-weekly updates, expanded competitor tracking, and multiple team seats.

3.1 Payment Terms All prices are listed in US Dollars (USD). Payment is processed securely through our third-party payment processor, Stripe. By providing your payment information, you authorise us to charge the applicable fees for your selected plan. One-time payments (Starter, or setup fees for Pro and Team monthly plans) are charged at the time of purchase and are non-recurring. Recurring payments (Pro and Team subscription plans) are charged on a monthly or annual basis depending on your selected billing cycle. Monthly subscriptions are billed every 30 days. Annual subscriptions are billed once per year. 3.2 Free Trial Period Where applicable, subscription plans may include a free trial period for the recurring portion of the fee. During this trial period, you will not be charged the recurring fee. At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends. 3.3 Price Changes We reserve the right to change our prices at any time. If you are on an active subscription, we will provide at least 30 days' written notice before any price change takes effect. Price changes will apply to the next billing cycle following the notice period.

Initial intelligence files for all packages will be delivered within 48 hours of receiving your complete company information and payment confirmation. We will make commercially reasonable efforts to meet this timeline, but delivery times may vary depending on the complexity of your request and the availability of data sources. For Pro and Team subscribers, bi-weekly update files will be delivered automatically on a schedule communicated to you at the start of your subscription. Intelligence files are delivered in structured JSON format via a secure delivery method communicated to you upon purchase.

5.1 Data Sources Our intelligence files are compiled using a combination of proprietary analysis, licensed third-party data sources, and publicly available information. We do not disclose the specific identity of our data sources except where required by those sources' licensing terms. 5.2 Accuracy and Limitations While we strive to provide accurate and current intelligence, all data is provided on an "as-is" basis. We do not guarantee the accuracy, completeness, or timeliness of any data contained in the intelligence files. Market conditions, competitor activities, and other data points change frequently, and there may be a delay between when a change occurs and when it is reflected in your intelligence file. The intelligence files are informational tools, not professional advice. You should not rely solely on Agent Fuel intelligence files for business, investment, legal, or financial decisions. We strongly recommend that you independently verify any data before making significant business decisions. 5.3 Your Use of Intelligence Files Upon payment, you receive a non-exclusive, non-transferable licence to use the delivered intelligence files for your internal business purposes, including loading them into AI agents, language models, and internal tools operated by or on behalf of your organisation. You may not: • Resell, redistribute, sublicense, or publicly share the intelligence files or their contents, whether in whole or in part. • Use the intelligence files to create a competing product or service. • Remove or alter any proprietary notices, attributions, or source citations contained in the files. • Misrepresent the source or origin of the data contained in the files.

6.1 Information You Provide To deliver the Service, we collect certain information from you, including but not limited to: your company name, company website URL, employee count, company stage, key business metrics, and any additional context or documents you voluntarily provide. This information is used solely to generate your intelligence files and improve our Service. 6.2 Confidentiality We treat all company information you provide as confidential. We will not share your company data, business metrics, or any information you provide with any third party, except as necessary to deliver the Service (e.g., processing payments through Stripe) or as required by law. Your intelligence files are generated exclusively for your company. We do not share, reuse, or incorporate your company-specific data into intelligence files generated for other customers. 6.3 Data Retention We retain your company information and intelligence files for the duration of your subscription or, for one-time purchases, for a period of 12 months following delivery. You may request deletion of your data at any time by contacting us at the email address provided on our website.

All intellectual property rights in the Service, including but not limited to the methodology, algorithms, file structures, analysis frameworks, and proprietary processes used to create intelligence files, remain the exclusive property of Agent Fuel. The licence granted to you under Section 5.3 does not transfer any ownership rights. The raw data contained in intelligence files may originate from third-party sources and remains subject to those sources' respective terms and intellectual property rights.

8.1 Cancellation You may cancel your subscription at any time through your Stripe billing portal or by contacting us directly. Upon cancellation: • Your subscription will remain active until the end of the current billing period. • You will continue to receive scheduled updates until the end of the current billing period. • No further charges will be made after the current billing period ends. • You retain the right to use all intelligence files delivered prior to cancellation, subject to Section 5.3. 8.2 Refunds Starter Package: Because the Starter Package involves bespoke research and analysis, refund requests are evaluated on a case-by-case basis. If you are dissatisfied with the delivered intelligence file, please contact us within 7 days of delivery to discuss your concerns. Pro and Team Packages: Setup fees (one-time payments) are non-refundable once the initial intelligence file has been delivered. Recurring subscription fees are non-refundable for the current billing period but will not renew after cancellation. Annual subscriptions: If you cancel an annual subscription within the first 30 days, you may request a pro-rated refund for the unused portion. After 30 days, annual subscription fees are non-refundable.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will make commercially reasonable efforts to provide advance notice of any material changes that may affect your use of the Service. We do not guarantee uninterrupted or error-free operation of the Service. Scheduled maintenance, third-party data source outages, or unforeseen technical issues may temporarily affect availability or delivery schedules.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AGENT FUEL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO AGENT FUEL DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

THE SERVICE AND ALL INTELLIGENCE FILES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT: (A) THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS; (B) THE DATA IN INTELLIGENCE FILES WILL BE ACCURATE, COMPLETE, OR CURRENT; (C) THE RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE RELIABLE; OR (D) THE QUALITY OF THE SERVICE WILL MEET YOUR EXPECTATIONS.

You agree to indemnify, defend, and hold harmless Agent Fuel and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any business decisions made based on the intelligence files provided.

These Terms are effective from the date you first access or use the Service and continue until terminated. We may terminate or suspend your access to the Service immediately, without prior notice, if we reasonably believe that you have violated these Terms. Upon termination: (a) all licences granted to you under these Terms will immediately cease; (b) you must cease all use of the Service; and (c) any provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 5.3, 6, 7, 10, 11, 12, and 15.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms. If you do not agree with the modified Terms, you must discontinue use of the Service.

These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of laws principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Oslo, Norway.

Entire Agreement. These Terms, together with any applicable order forms or payment confirmations, constitute the entire agreement between you and Agent Fuel regarding the Service and supersede all prior agreements and understandings. Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction. Force Majeure. We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, or failures of third-party data sources or infrastructure.

We use Microsoft Clarity to collect anonymous usage data about how visitors interact with our website. This includes page views, clicks, and scroll behavior. Clarity uses cookies that are only activated with your explicit consent via our cookie consent banner. You can manage your cookie preferences at any time using the cookie banner on our website.
